These Terms of Service (these “Terms”) govern your access to and use of the Luna USA mobile application, website, and all related technology platform services, features, content, and functionality made available by The Lighthouse Garden LLC, a CA limited liability company (“Luna USA,” “Company,” “we,” “us,” or “our”) (collectively, the “Platform”).
Please read these Terms and the Privacy Policy set forth in Exhibit 1 below carefully before accessing or using the Platform. By downloading, accessing, registering for, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms or the Privacy Policy incorporated herein, you may not access or use the Platform.
The Platform is a technology-based marketplace that enables users to search for, schedule, and pay for certain at-home wellness and beauty-related services offered by independent third-party service providers. Luna USA does not itself perform, provide, supervise, direct, control, or assume responsibility for any hands-on services offered or rendered by any Service Provider, and Luna USA is not a party to the underlying service relationship between a customer and a Service Provider except as expressly set forth in these Terms.
1. NATURE OF THE PLATFORM. Luna USA operates solely as an online technology platform that facilitates introductions, booking coordination, communications, payment processing, and related support functions between customers and independent third-party service providers offering at-home wellness and beauty-related services, including, without limitation, massage, belly binding, facial services, and other wellness treatments made available through the Platform (collectively, the “Services”).
Luna USA does not itself provide massage, beauty, facial, wellness, or other hands-on services. All Services are offered and performed solely by independent third-party service providers (“Service Providers”) acting for their own account and not on behalf of Luna USA.
Nothing in these Terms shall be construed to create any employment, agency, partnership, joint venture, franchise, fiduciary, or similar relationship between Luna USA and any Service Provider, or between Luna USA and any user, except for the limited contractual relationship expressly created by these Terms with respect to your access to and use of the Platform.
Luna USA’s role is strictly limited to operating the Platform and facilitating booking-related transactions. Luna USA does not control, and expressly disclaims responsibility for, the quality, timing, legality, safety, suitability, qualifications, licensure, credentials, conduct, omissions, or performance of any Service Provider or any Services performed by any Service Provider.
2. ELIGIBILITY. To use the Platform, you must be at least twenty-one (21)[JP1] years of age and legally capable of entering into a binding contract under applicable law.
By accessing or using the Platform, you represent and warrant that:
(a) you satisfy all eligibility requirements set forth in these Terms;
(b) all information submitted by you to Luna USA is true, accurate, current, and complete; and
(c) your access to and use of the Platform does not violate any applicable law, regulation, or contractual restriction.
Luna USA reserves the right, in its sole discretion, to deny access to the Platform, suspend or terminate any account, or request additional verification information at any time if Luna USA believes that a user does not satisfy the eligibility requirements or has provided false, incomplete, misleading, or inaccurate information.
3. ACCOUNT REGISTRATION AND SECURITY. To use certain features of the Platform, you may be required to create an account and provide certain registration information. You agree to provide accurate, current, and complete information and to keep such information updated.
You are solely responsible for:
(a) maintaining the confidentiality of your account credentials;
(b) restricting access to your device, account, and login information; and
(c) all activities occurring under your account, whether or not authorized by you.
You must notify Luna USA promptly of any unauthorized use of your account, suspected compromise of your login credentials, or any other security incident relating to your account or use of the Platform. Luna USA shall have no liability for any loss, damage, or unauthorized activity arising from your failure to safeguard your account credentials or maintain account security.
4. BOOKING PROCESS. Through the Platform, a customer may browse available Services, review Service Provider profiles, select a Service Provider, choose an available appointment date and time, specify the service location, and submit payment for the requested booking.
A booking request submitted through the Platform constitutes a request for Services only and shall not become binding unless and until such request is accepted by the applicable Service Provider and reflected as confirmed through the Platform.
Service availability depends on multiple factors, including, without limitation, Service Provider availability, geographic coverage, selected appointment time, service category, operational constraints, safety considerations, technical functionality, and payment authorization.
Luna USA makes no representation or warranty that any requested Service, Service Provider, appointment slot, or service location will be available.
All Services offered through the Platform are offered on a mobile, at-home basis. Luna USA does not own, lease, manage, operate, or maintain any fixed retail location, treatment facility, storefront, or service premises for the delivery of Services.
5. INDEPENDENT SERVICE PROVIDERS. All Service Providers made available through the Platform are independent contractors and independent business operators, and not employees, agents, representatives, partners, or joint venturers of Luna USA.
Each Service Provider independently determines such Service Provider’s own working hours, service location, manner of performing Services, pricing, and acceptance or rejection of booking requests. Service Providers may also determine whether to modify or decline service arrangements based on scheduling availability, location, safety considerations, or other operational circumstances.
Service Providers are solely responsible for providing and maintaining any equipment, tools, supplies, or materials necessary for the performance of Services.
Luna USA does not control the manner or means by which any Service Provider performs Services. Luna USA’s role is limited to providing the Platform, facilitating bookings, transmitting communications, and processing payments. Luna USA shall not be responsible or liable for the quality, timeliness, legality, safety, suitability, or outcome of any Services performed by any Service Provider, or for any act, omission, negligence, misconduct, or failure to perform by any Service Provider.
6. PRICING AND FEES. Prices for Services are set by the applicable Service Provider. In addition to the Service Provider’s listed price, Luna USA may charge a separate platform service fee, which will be disclosed through the Platform prior to checkout.
By confirming a booking, the customer agrees to pay the total amount displayed at the time of booking. All prices and fees displayed through the Platform for a confirmed booking are final and not subject to negotiation through the Platform.
Luna USA reserves the right to adjust platform fees, pricing displays, or fee structures at any time, provided that any such modification shall not affect a booking already confirmed and paid for.
7. PAYMENT. Payments for bookings must be completed through the Platform using supported payment methods. Cash payment for booked Services is not permitted, provided that customers may give tips directly to the applicable Service Provider in cash, if permitted by applicable law. Luna USA is not responsible for payment failures, processing delays, or other payment-related issues caused by any third-party payment processor, payment gateway, financial institution, or card issuer.
8. COMMUNICATION AND TRACKING. The Platform may provide in-app messaging, notices, announcements, tracking, and other booking-related features. Customers and Service Providers are responsible for reviewing relevant messages, notices, and updates made available through the Platform. Any tracking or status information provided through the Platform is for convenience only, is approximate in nature, and may be affected by technical limitations or other circumstances beyond Luna USA’s control. Misuse of any communication feature may result in suspension or termination of access to the Platform.
The Platform may include an in-app emergency (“SOS”) button. When activated, the feature may allow the Platform to assist in contacting local emergency services if necessary. This feature is provided solely as a convenience and does not constitute emergency response services. Luna USA shall not be responsible for any delay, failure, or outcome related to the use of such feature.
9. CANCELLATIONS AND REFUNDS. Cancellation and refund eligibility may depend on the timing of the cancellation, the type of Service, the circumstances of the booking, the reason for the cancellation or complaint, and the results of Luna USA’s review.
If a customer seeks a refund based on alleged no-show, substantial delay, or material non-performance by a Service Provider, the customer must notify Luna USA within twenty-four (24) hours after the scheduled appointment time.
Upon receiving such notice, Luna USA may review and investigate the matter. If Luna USA determines that the complaint is substantiated, Luna USA may contact the customer and process an applicable refund within approximately three (3) to seven (7) business days.
Luna USA reserves the right to investigate all refund requests and to determine, in its reasonable discretion, whether a refund, partial refund, service credit, rescheduling option, or no relief is appropriate under the circumstances.
Except as otherwise required by applicable law, nothing in these Terms obligates Luna USA to issue a refund in every instance of dissatisfaction, inconvenience, delay, cancellation, or dispute.
Luna USA may establish, revise, or supplement cancellation and refund rules from time to time through separate platform policies, FAQs, checkout disclosures, or other notices made available through the Platform, and such rules shall be deemed incorporated into these Terms by reference.
10. CUSTOMER RESPONSIBILITIES. As a condition of your access to and use of the Platform, you agree that you shall:
(a) provide accurate, complete, and current registration, booking, contact, and payment information;
(b) ensure that the service location is reasonably safe, sanitary, accessible, lawful, and suitable for the requested Service;
(c) ensure that the service location does not present unreasonable risks to the Service Provider or any third party;
(d) be present, available, and reasonably prepared for the scheduled appointment;
(e) treat all Service Providers with courtesy, professionalism, and respect;
(f) review and respond, where appropriate, to notices, messages, announcements, and service-related communications delivered through the Platform;
(g) comply with all applicable laws, regulations, and these Terms; and
(h) refrain from conduct that may interfere with, jeopardize, or impair the safety, performance, or integrity of the Services or the Platform;
(i) not exchange personal contact information with a Service Provider for the purpose of arranging services outside the Platform; and
(j) not request, solicit, offer, or engage in any illegal, inappropriate, or sexually related services through the Platform.
You are solely responsible for determining whether a requested Service is appropriate for your own personal circumstances, preferences, condition, or needs. If you have any health concerns, allergies, sensitivities, medical conditions, physical limitations, or other relevant issues, you are solely responsible for disclosing them to the Service Provider before the Service begins.
11. DISCLAIMER OF WARRANTIES. To the maximum extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis. Luna USA makes no representations or warranties of any kind regarding the Platform or any Services arranged through the Platform. Luna USA does not guarantee the quality, safety, legality, or performance of any Services provided by any Service Provider.
12. LIMITATION OF LIABILITY. Luna USA operates solely as a technology platform connecting customers with independent Service Providers and does not provide the Services itself.
To the maximum extent permitted by applicable law, Luna USA shall not be liable for any personal injury, allergic reactions, dissatisfaction, damages, or losses arising from or related to Services provided by any Service Provider.
Luna USA shall also not be responsible for any indirect, incidental, or consequential damages arising out of or related to the use of the Platform or any Services arranged through the Platform.
Nothing in these Terms shall exclude or limit liability to the extent such liability cannot be excluded under applicable law.
13. INDEMNIFICATION. You agree to defend, indemnify, and hold harmless Luna USA and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
(a) your use of the Platform;
(b) any Services arranged through the Platform;
(c) your violation of these Terms; or
(d) your interactions or disputes with any Service Provider.
14. TERMINATION. Luna USA reserves the right, in its sole discretion, to suspend, restrict, or terminate your access to the Platform at any time if you violate these Terms, engage in unlawful or abusive conduct, misuse the Platform, or create risks or legal exposure for Luna USA or other users.
15. CHANGES TO TERMS. Luna USA may update or modify these Terms from time to time in its sole discretion. Any updated version will be posted through the Platform or otherwise made available to users. Continued access to or use of the Platform after such changes become effective constitutes acceptance of the revised Terms.
16. DISPUTE RESOLUTION. In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform, you and Luna USA agree to first attempt to resolve the matter through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be resolved by binding arbitration in the State of California in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
17. GOVERNING LAW. The validity, interpretation, construction and performance of these Terms, and all acts and transactions pursuant hereto and the rights and obligations of you and Luna USA shall be governed, construed and interpreted in accordance with the laws of the state of California, without giving effect to principles of conflicts of law.
